Colorado’s AI compromise would focus regulations on informing consumers when the technology is used

Companies that build and deploy artificial intelligence systems in Colorado would not be required to reveal exactly how those systems reach decisions on hiring, loans, or housing under a new bill introduced Friday in the state Senate. The proposal represents a significant adjustment to Colorado's landmark AI regulation law, which was the first of its kind in the country when it passed.

Instead of forcing companies to open their algorithms for inspection, the revised measure would place a heavier emphasis on simply telling consumers when AI is being used to make decisions that affect them. The long-awaited bill aims to strike a balance between protecting the public from potential bias or errors in automated systems and not burdening tech companies with overly strict transparency rules that could stifle innovation.

Supporters of the compromise argue that requiring full disclosure of how an AI model works is often impractical, as many systems are too complex for even their creators to fully explain. By focusing on notification, the bill would ensure that people know they are being evaluated by a machine, giving them a chance to request a human review of the decision. Critics, however, worry that without deeper transparency, consumers will have little recourse if an AI system makes a harmful or unfair judgment. The bill now moves to committee for further debate.
